The Law Suit Against Zair Smedlyaev Came to Its End

The law suit against the Head of the Secretariat of Mejlis, Zair Smedlyaev, lasting for 14 months, finished last week. Let us remind, that Zair Smedlyaev was accused of active participation in group violation of the public order (Art. 293 of the Criminal Code of Ukraine) and resistance to the law enforcement officers in connection with the execution of their duties, made by a group of people without the previous concert (part 1, art. 28, part 2 art. 342 of the Criminal Code of Ukraine). According to the newspaper “Avdet” the Zheleznodorozhny Court of Aqmescit found Z.Smedlyaev guilty in committing of the mentioned above crimes and sentenced him to four months of prison (in accordance with the article 293 of the Criminal Code of Ukraine) and five months of prison (in accordance with part 1 art. 28, part 2 art. 342 the Criminal Code of Ukraine). However, Mr. Smedlyaev didn’t admit himself guilty. According to the Head of the Secretariat, the courts found his non-admittance for a means of defend and attempt to avoid the responsibility. The court also was critical about the evidences of the eyewitnesses, made during the law suit and didn’t take to consideration the arguments of the advocate and defendant.

Z. Smedlyaev was exempted from the court’s sentence because of the expiry of limitation of institution of criminal proceedings. The restraint against Mr. Smedlyaev – a written undertaking not to leave the country was canceled. The court decided to charge Mr. Smedlyaev 120 UAH towards Sergey Chigrin as the reparation of damages. Zair Seitablaevich Smedlyaev was also charged 2057, 98 UAH towards the Court of Appeal of ARC as the reparation of damages.

Mr. Smedlyaev stated that he didn’t agree with the court’s decision and was going to appeal this decision.

Let us remind that on June 22, 2006 Zair Smedlyaev was present at the site of the events, held next to the Court of Appeal of the Autonomous Republic of Crimea where the case against the participants of the fight in night club “Cotton” in Aqmescit was heard. According to the official version and the accusatory statement Zair Smedlyaev guided the meeting, held next to the Court of Appeal, attended by around 500 Crimean Tatars. After the court registrar declared that no one would be allowed to enter the court (including the parents of the accused Abdullaev K.S., Malaev L.L., Seitkhalilov F.F., Khayredinov S.Sh, Kurtametov E.I. whose appeal was considered by the panel of judges of the criminal court of AR Crimea), because of the lack of seats, there was an unrest among the participants of the meeting and there were the attempts to enter the court that were opposed by 10 law enforcement officers of the Zeleznodorozhny branch of Militia. According to Zair Smedlyaev the law enforcement officers violated the current law, abused their powers and prevented the activity of the members of the VR of ARC and didn’t let the members of the Verkhovna Rada of the Autonomous Republic of Crimea and regional council to the Court of Appeal that resulted in confrontation between the law enforcement officers and the people that gathered on the square in front of the court. As a result of the unrest the law enforcement officers received moderately severe injuries.
