Draft Law «On the Restoration of the Rights of Persons, Deported on the National Grounds» to be Considered in Second Reading
The Committee on Human Rights, national minorities and interethnic relations prepares to consider the Draft Law “On the Restoration of the Rights of Persons, Deported on the National Grounds” in the second reading at the 11th session of the Verkhovna Rada of Ukraine of the 6th convocation, the official website of the Verkhovna Rada of Ukraine reports.
The document (№ 5515), adopted by the Verkhovna Rada on June 20, 2012 provides for the status of the persons, deported on the national grounds, the guarantees for the restoration of their rights, principles of the state policy and powers of the state bodies, local bodies of self-governance on the restoration of the rights of these persons.
The document also includes the norm, providing that the person that acquired the citizenship of Ukraine should be considered the deportee if he belongs to:
– Crimean Tatars, national minorities (citizens of the former USSR) that during 1941 – 1944 were forcibly replaced on the national grounds to the places of special settlement in accordance with the order of the state authorities of the former USSR or Soviet Republics from their permanent residence that located on the territory of today’s Ukraine;
– the persons (citizens of the former USSR) that were forcibly sent to the special settlements to join their families after the military service, the return from evacuation, served forced labor, sentence, etc.;
– the persons (citizens of the former USSR) that at the moment of deportation 1941 – 1944 were outside the places of their permanent settlement (at military service, in evacuation, forced labor, prison, etc.), but who were later limited in their rights and freedoms on the national grounds, including the prohibition to return and live in the places of their permanent residence;
– the persons, born in the families of the deported persons before the moment of their return to the places of their permanent residence.
The draft law also provides for the mechanism of acquisition of the status of the deported person, the state guarantees to the deported persons and members of their families that returned to Ukraine to the permanent residence, the procedure of the reimbursement for the property, confiscated during the deportation, etc.
The document also provides for the powers of the bodies of the executive power and local self-governance in restoration of the rights of persons, deported on the national ground.
We would remind you that on June 20, 2012 the Verkhovna Rada of Ukraine adopted the Draft Law of Ukraine “On the restoration of the rights of persons, deported on the national grounds” in the first reading and sent it to consideration in the second reading.
The draft law # 5515, the author – the Leader of Mejlis of the Crimean Tatar people Mustafa Jemilev was registered in 2012.
Earlier the similar draft law was adopted by the Parliament, but was vetoed by the President of Ukraine in 2004.
